No Criminal Action on Claims Okada Falsified TRLEI Documents
The Makati prosecutor’s office in the Philippine capital Manila has decided not to pursue three criminal complaints against Japanese entrepreneur Kazuo Okada (pictured) for falsifying certain documents, including a submission to a bank telling him that There were new signing officers for Tiger Resort, Leisure and Entertainment Inc (TRLEI), an entity responsible for the operation of Okada Manila Casino.
According to local media, Deputy District Attorney Kristina So-Reyes ruled there was no probable cause to charge Mr. Okada and four others with tampering with a public document by an individual; use of falsified document; and falsifying and misrepresenting in a company secretary’s certificate issued to a local bank.
The complaints were filed by Hajime Tokuda, head of Japanese entertainment conglomerate Universal Entertainment Corp, the parent company of TRLEI. Mr. Okada had been ousted from Universal Entertainmenta group he founded, and then from TRLEIin June 2017, amid allegations that he committed fraud, which he denied.
Reports say Mr Tokuda alleged in his May 30 complaint this year that Mr Okada and four supporters engaged in forgery regarding a letter dated May 3, 2022 and a company secretary certificate. dated May 4, 2022.
But the Makati City Prosecutor’s Office ruled that the actions of Mr Okada and the other four were linked to a standstill order issued by the Supreme Court of the Philippines on April 27, which reinstated the board. of TRLEI as it was before Mr Okada was ousted in 2017.
Following the Supreme Court ruling, Mr. Okada’s representatives physically busy the Okada Manila complex on May 31, and have been there ever since.
The Universal Entertainment side argues that not only is Mr. Okada’s decision to occupy Okada Manila a misinterpretation of the court order, but it also distracts from the real problem.
The Japanese conglomerate says the real problem is that the ultimate and true controller of Universal Entertainment – and by extension TRLEI – is a private Hong Kong company called Okada Holdings Ltd, which Universal Entertainment claims is majority-owned, at 53.27%, by Son of Mr. Okada Senior, Mr. Tomohiro Okada.
The question of who should control TRLEI and the resort town of Okada Manila is still up in the air. challenged in the Supreme Court of the Philippines.
“Whether the Standstill Order was validly issued or whether Respondent Okada can validly claim majority ownership of Plaintiff [TRLEI] are…problems that cannot be transmitted through this [prosecutor’s] office, given the ongoing action between the parties in the Supreme Court,” Assistant District Attorney Ms. So-Reyes said, in a July 22 decision, released August 8, and quoted by broadcaster ABS-CBN .
In July, it emerged that the Philippine Court of Appeals had affirmed his December decision which dismissed charges of “estafa” – ie fraud – against Mr. Kazuo Okada and an associate, Takahiro Usui, regarding TRLEI.
